The UK’s Digital Regulation Cooperation Forum, a joint body comprising the Financial Conduct Authority, the Information Commissioner’s Office, Ofcom, and the Competition and Markets Authority, has published what Reed Smith described as “the UK’s most detailed cross-regulatory assessment yet” of autonomous AI agents. The DRCF foresight paper, published March 31, identifies seven compliance risk areas that apply to any organization deploying agents, with particular urgency in financial services.
ICAEW’s analysis, published April 27, breaks down the implications for accounting and financial services firms.
The Seven Risk Areas
The DRCF paper identifies the following compliance exposures, according to ICAEW:
Fragmented accountability. When errors occur in multi-agent systems, responsibility splinters across model providers, system integrators, and deploying organizations. The DRCF calls this the “many hands problem” and notes that each layer of the value chain has distinct mitigation obligations: model providers for logging and emergency shutdowns, system providers for context-specific risk controls, deployers for oversight and reporting.
Vendor lock-in. Organizations relying on a single agent provider’s infrastructure risk losing interoperability and negotiating leverage. The paper acknowledges a counterpoint: agents could also reduce lock-in by serving as integration layers between different systems.
Black-box decision-making. Multi-agent systems risk becoming opaque to users, deployers, and regulators. This lack of transparency can result in non-compliance with consumer protection, contract, and data protection laws because decisions become difficult to trace or contest.
Data protection and privacy. Agents typically require broad data access to perform effectively, creating tension with UK GDPR data minimization requirements. Automated multi-step workflows may also undermine a user’s ability to provide informed consent.
Algorithmic collusion. Agents may spontaneously learn to coordinate outcomes or exchange commercially sensitive information without explicit instruction from their operators.
Cybersecurity vulnerabilities. Agents granted excessive permissions create expanded attack surfaces that adversaries can exploit for data extraction or system manipulation.
Financial services compliance. Agents pricing products or triaging insurance claims must demonstrate compliance with the FCA’s Consumer Duty, which requires firms to prove that automated actions deliver good outcomes for clients.
The Accountability Principle
The core regulatory position is unambiguous. “Despite an agent’s degree of autonomy, the deploying organisation remains legally responsible for compliance,” the DRCF states, as ICAEW reported. All four regulators agree that AI agents do not fall outside existing UK regimes. Transparency, fairness, safety, consumer protection, and competition obligations continue to apply.
Esther Mallowah, head of tech policy at ICAEW, told ICAEW: “AI agents could amplify existing generative AI risks and introduce new ones. As seen in recent months, they can create significant risks, particularly around data security and privacy.”
Cross-Regulatory Overlap
Lewis Silkin’s analysis highlighted a practical problem: a single agentic deployment can trigger obligations across all four regulators simultaneously. A retail agent powered by agentic AI, for example, could activate FCA rules on financial promotions, ICO requirements on data processing, CMA competition concerns, and Ofcom transparency obligations in a single interaction.
The DRCF launched a Thematic Innovation Hub focused specifically on agentic AI alongside the paper. Kate Jones, DRCF’s CEO, said at the launch: “Agents operate at machine pace while assurance runs at human speed, liability becomes blurry as agents make autonomous decisions, and user literacy becomes crucial to ensure consumers understand risks.”
The Enterprise Deployment Question
The paper recommends traceable logs, human-in-the-loop checkpoints, transparency agents, and system mapping to maintain audit trails. For financial services firms already deploying agents to customer support and fraud detection, these are not future considerations. They are current compliance requirements.
For agent builders outside the UK, the DRCF paper signals the regulatory template that other jurisdictions are likely to follow. The seven risk areas map cleanly onto the EU AI Act’s requirements for high-risk AI systems, and the FCA Consumer Duty framework is being studied by financial regulators in Singapore, Australia, and Hong Kong, according to Reed Smith.
